Many states disagree and have sued or sent cease-and-desist letters. Federal appeals courts have split, and the Supreme Court has been asked to decide. Check each app in your state.
On a prediction market you trade contracts on a result (Yes or No) against other people, and the price moves. DFS pick'em is a fantasy contest: you pick More or Less on player stats against a fixed payout chart. They're regulated differently, so they're open in different states.
